Welcome to Libro Chiquito. By accessing or using our website (librochiquito.com), mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

Libro Chiquito is a platform that creates personalized children's books using artificial intelligence. Users provide personal details (names, ages, interests, photographs) and our AI systems generate unique stories and illustrations. Books are available as digital downloads and optional printed hardcover copies.

2. Eligibility

• You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.
• By using the Service, you represent that you have the legal authority to provide information about the child for whom you are creating a book.
• You represent that you are the parent, legal guardian, or have obtained explicit consent from the parent or legal guardian of any child whose information you provide.

3. Account and Security

• Accounts are created automatically upon your first purchase or can be created through our login system.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Book Creation and Content

4.1 User-Provided Content

You are solely responsible for the accuracy and appropriateness of all information and photographs you provide during the book creation process. You represent and warrant that:

• All photographs you upload are of individuals for whom you have the right to use their likeness.
• You have consent from the parents or guardians of any minors whose photographs you upload.
• The information you provide does not infringe on any third party's rights.
• You will not submit content that is offensive, harmful, illegal, or inappropriate for children.

4.2 AI-Generated Content

Stories and illustrations are generated by artificial intelligence. While we strive for quality and appropriateness:

• AI-generated content may occasionally contain errors, inaccuracies, or unexpected results.
• Illustrations are interpretations based on your inputs and may not perfectly match expectations.
• We do not guarantee that AI-generated content will be free from all imperfections.
• We implement safeguards to prevent inappropriate content, but no system is infallible.

4.3 Content Review

We reserve the right to review, refuse, or remove any content that we determine, in our sole discretion, violates these Terms, is inappropriate, or could harm our platform, users, or reputation.

5. Intellectual Property

5.1 Your Content

You retain ownership of the photographs and personal information you provide. By uploading content, you grant us a non-exclusive, worldwide license to use, process, and transmit that content solely for the purpose of creating your personalized book and fulfilling your order.

5.2 Generated Content

Upon purchase, you receive a personal, non-exclusive, non-transferable license to use the generated story and illustrations for personal, non-commercial purposes. This includes:

• Reading and sharing the digital book within your family.
• Printing additional personal copies.
• Sharing excerpts on personal social media.

5.3 Restrictions on Generated Content

You may NOT:

• Resell, redistribute, or commercially exploit the generated stories or illustrations.
• Claim authorship or copyright over AI-generated content.
• Use generated content to create derivative commercial products.
• Remove or alter any Libro Chiquito branding from printed books.

5.4 Our Intellectual Property

The Libro Chiquito name, logo, website design, software, and underlying technology are our exclusive property. You may not copy, modify, reverse-engineer, or create derivative works from our platform or technology.

6. Anti-Piracy and Content Protection

6.1 Prohibition of Piracy

You agree not to engage in any form of piracy or unauthorized reproduction of content created through or obtained from our platform. Specifically, you agree NOT to:

• Copy, reproduce, or distribute books created on our platform for commercial purposes.
• Share download links, PDFs, or digital copies of purchased books with unauthorized parties.
• Use our platform to generate content that infringes on third-party copyrights, trademarks, or intellectual property rights.
• Circumvent, disable, or interfere with any digital rights management, access control, or content protection mechanisms.
• Use automated tools, bots, or scripts to mass-generate, download, or scrape content from our platform.
• Reproduce the visual style, illustrations, or story templates of our books to create competing products.

6.2 Reporting Piracy

If you become aware of unauthorized reproduction or distribution of content from our platform, please report it to [email protected]. We take intellectual property protection seriously and will investigate all reports.

6.3 Consequences of Violation

Violations of our anti-piracy policies may result in:

• Immediate termination of your account without refund.
• Removal of all associated content.
• Legal action to recover damages and enforce our rights.
• Reporting to relevant law enforcement authorities where applicable.

7. Payments and Refunds

7.1 Pricing

• Digital book prices are displayed at checkout and include applicable taxes.
• Printed book prices include production costs. Shipping costs vary by destination.
• Bundle pricing (digital + hardcover) may include promotional discounts available only at the time of initial purchase.

7.2 Refund Policy

• Digital books: Due to the personalized and instantly-delivered nature of our digital books, refunds are generally not available once the story has been generated. If you experience a technical issue that prevents you from accessing your book, contact us for assistance.
• Printed books: If your printed book arrives damaged or with significant printing defects, contact us within 14 days of delivery for a replacement or refund.
• Order cancellation: You may cancel a printed book order before it enters production. Once in production, cancellation is not possible.

8. Shipping and Delivery

• Printed books are produced by third-party printing partners and shipped to the address provided at checkout.
• Delivery times vary by destination and printing partner (typically 5-15 business days).
• We are not responsible for delays caused by customs, postal services, or force majeure events.
• Physical book shipping is available only in select countries. See our shipping page for current availability.

9. Prohibited Uses

You agree not to use the Service to:

• Create content that is illegal, threatening, abusive, harassing, defamatory, or obscene.
• Upload photographs of individuals without their consent or the consent of their legal guardian.
• Impersonate any person or entity.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Inject malicious prompts, instructions, or code into input fields to manipulate AI behavior.
• Use the Service to generate content that infringes on intellectual property rights.
• Systematically extract or harvest data from our platform.
• Interfere with or disrupt the Service or its infrastructure.
• Use the Service for any commercial purpose not expressly authorized by us.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free.
• AI-generated content will meet your specific expectations.
• Printed book quality will exactly match digital previews.
• Colors in printed books will exactly match on-screen display.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIBRO CHIQUITO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF BUSINESS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC BOOK OR SERVICE GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Libro Chiquito, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Governing Law and Dispute Resolution

• These Terms are governed by the laws of Mexico.
• Any disputes arising from these Terms or the Service shall be resolved through negotiation first.
• If negotiation fails, disputes shall be submitted to the competent courts of Guadalajara, Jalisco, Mexico.
• You waive any objection to jurisdiction or venue in these courts.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
